Real Life Stories -Could Be You

Note: All of these stories are true. Some have fictitious names due to the desire of the individuals.

Auto Repossession: Elizabeth Lountz and her husband John Lountz are in their early sixties. They are through raising their family and decided after many years of being relegated to renting, that they wanted a little home of their own. Elizabeth works at one of the local hospitals and William works for one of the local car dealers as a detail man.

Neither have a college education, much less a high school education. Their meager savings (about $6,500) equated to a ten percent (10%) down payment on the home of their choice in their neighborhood. Doesn’t seem like anyone can purchase a home for under $75,000 but they found one. Well, when they applied for a mortgage, they thought that their credit was decent. After all, these poor folks paid most of their bills by going to the post office and buying postal money orders.

Being basically poor, the only thing that they ever financed was a few pieces of furniture and some used cars during their lifetime. They never had the luxury of buying a brand new car so they always went to the used car lots and listened to the false promises of you know who. Well it seems that Lizzie (nickname) bought a used Nissan from Ugly Rabbit Used Car Sales

They were kind enough to sell her a $1,000 car for $2,000 plus interest (about 36%). After a down payment of $250 and making monthly payments for over eighteen months, Lizzie got sick at work and had to take some time off. Naturally they couldn’t make the car payments so William and Lizzie drove on down to Ugly Rabbit and told the manager about their problems.

The manager was salivating because William had the car in better shape than when they bought it almost eighteen months previous. Lizzie was distraught because she couldn’t keep up with the payments. The manager told her not to worry about anything. They probably will sell the car and she wouldn’t have to make her last six months payments.

Lo and behold, we pulled up their credit report in the process of getting them approved for a mortgage. Yep, there in black and white was an entry. “Ugly Rabbit Auto Finance” for the family indicating a “voluntary repossession”. Mind you the word repossession means repossession. Whether or not it’s involuntary or voluntary, the credit experts don’t give a hoot. The simple fact that you have a, repossession is a no-no in credit.

When we read that, I immediately called Lizzie and asked her if she had received any correspondence from the dealer or finance company informing her of the date, place and time of sale. She was emphatic. She received nothing. Here is where knowledge steps in.

I was casually reading the Attorney General’s website for the state of Florida one night. I was curious about repossessions. Wow, what, an education. I found a test case in Tallahassee, FL regarding Barnett Bank versus Johnson. I believe it was the 6th Circuit Ct. The bank was suing Johnson for a deficiency judgment regarding repossession of his pickup truck

Failure to Notify

The bank failed to notify Mr. Johnson of the date, time and place of sale. Furthermore, the sale was conducted at a dealer only auction. Without notifying Mr. Johnson of any of the above, the Judge ruled that because Mr. Johnson was deprived of the right to redeem his truck and therefore lost any vested interest, the amount of what the bank received constituted full payment and the bank waived it’s right for a deficiency judgment.

Secondly, when the truck was sold at a dealer only auction, the public was deprived of the right to bid; therefore the amount received did not constitute fair marker value. The truck was sold in what was described as a commercially unreasonable sale.

When I realized the impact of this test case, it became apparent that the Lountz family was a victim of the same circumstances. Now remember the Fair Credit Reporting Act and the Fair Debt Collection Act. The dealer could not furnish the Lountz family with 100% of the information regarding their account.

Hell, he couldn’t furnish proof of sending them mailings telling them where the car was going to be sold. He knew he was selling it to his buddy down the street. There was no auction sale. The dealer clearly circumvented the law. So when they wrote the dispute letter to the credit reporting agencies and requested all of the information regarding the transaction, no one could supply a thing.

The result was that Elizabeth called me excited one night. She said “Mr. Regis, I have a letter from the credit reporting agency. They denied us.” I said “Elizabeth spell me denied”. The answer was spelled deleted. I said, Elizabeth, your repossession was deleted from your credit report. End of this story. They got their mortgage and send me a card every Christmas.

After helping about twenty-five people in the Orlando area, I see a strange thing happening. Now the local newspapers are heavily advertising bank and finance company repossession sales. PUBLIC INVITED, NO DEALERS. Amazing what one man’s quest becomes another man’s means of survival.

I have many stories about repossessions. The simple fact is, the dealers (mostly used car dealers) know the law or are totally ignorant. They think that these poor unfortunates fell off of the last fruit truck to leave town.

They have no place to turn to so they just go on about life and continue to be prey to high interest rates and unscrupulous lenders. I hope that the knowledge that I gained can help other poor, unfortunate souls. I can write stories upon stories about repossessions but still have other areas to cover.

The History of Scammell Trucks

Scammell began when George Scammell of Spitalfields, London developed his business. 

George Scammell’s great nephew, Lt Col Alfred Scammell was injured and invalided out of the army during World War 1 and he was able to apply the practical experience he had gained during the war and began developing the articulated six wheeler, which began production in 1920. 

1929 saw the introduction of the articulated “hundred tonner” heavy haulage vehicle and only two of these vehicles were produced.  The early 1930s saw the production of the 3 wheeled “Mechanical Horse”.  It featured automatic carriage coupling and the single front wheel could be steered through 360 degrees. 

During World War 2, Scammell made a massive contribution to the war effort by building large numbers of tank transporters, gun tractors and heavy recovery vehicles as well as fire pumps.

In the late 1940s, Scammell produced the Scarab, which replaced the “Mechanical Horse”.

1955 saw Scammell become part of the Leyland Group and this provided ready access to the Leyland engines, gearboxes and axles.  A gradual replacement for the lightweight range by new models using Leyland engines including the 4×2 Highwayman MU and a 4×2 forward control MU called the Handyman.  Many military versions were supplied to the Ministry of Defence.  However, pressure from UK hauliers resulted in the development of 4×2 versions.   So popular were these units that production was transferred to Guy Motors at Wolverhampton.

The late 1970s saw a surge in development and the birth of the Contractor Mark 2 heavy hauler and the first Commander Tank Transporter for the British Army were produced.  Two developments by Leyland Motors at the end of the 1970s benefited Scammell.  Leyland wished to develop two new heavy vehicle ranges, the overseas bonneted Landtrain and the UK forward control Roadtrain that would feature the new C40 tilt cab.

In 1987, Scammell learned that the tender for 1522 such vehicles was successful, but also that the Leyland Group had been purchased by DAF BV of Holland.

In July 1988, the Watford factory closed.  The S24 and the Nubian ranges, together with the rights to the Crusader and Commander were sold to Unipower Ltd, who opened a new plant in West Watford.

Herculiner Bed Liner — Tips For Success

A Herculiner bed coating costs only about one-fourth what a professionally applied bed liner will.  It’s natural to go for the do-it-yourself solution.  The two coatings are similar but not really equivalent.

A professional spray on liner, like one from Line-X or Rhino Coatings, derives it’s durability from the type of coating and from the thickness.  The material in these professional liners comes as a two-part paint that’s extra tough and extra fast drying.  The real key to the durability though is the thickness of the coating.  Professional liners consist of up to about 5 gallons of “paint.”  Put that much roll on bed liner paint on yourself and you’ll see very little savings over letting somebody else do it for you.

But for many applications, a paint on bed liner works well enough.  Especially for older trucks, the do-it-yourself coating certainly improves looks.  It adds a measure of protection at the same time.  Here’s how to make sure the coating works for you.

Cleaning the surface to be coated is nothing but boring work, but it is essential as a first step to get paint to stay on.  Cleaning must include using a solvent that will remove old grease and wax.  Just washing won’t do.  Paint can’t stick to a greasy waxed surface.

After cleaning comes some rough work.  It’s rough sanding that must happen.  No fine sanding is required but very rough sanding helps the paint stick and stay stuck.  On an older truck the sanding step is where you get to repair existing damage while you are at work.

Next, any bare paint should be spot primed.  Using a primer over the whole bed certainly can’t hurt, but really isn’t necessary.  Make sure to prime bare places though.

Actually applying the bed liner paint is the easiest part of the whole project.  After proper preparation. putting the paint on is so simple.  It may seem may seem that applying paint with a brush or roller produces inferior results compared to spray.  It’s not so.  Thick bed liner paint settles as it dries and all the roller or brush marks just fade away.

Herculiner bed coating works especially well on older trucks with damaged paint.  Getting the surface to be coated properly cleaned and sanded is key to a successful bed liner project.  The work to be done is simple but it does take time and effort.

Donate Your Boxes

Believe it or not, you can donate your boxes to the companies that sell new and used moving boxes. Many companies take a portion of the proceeds from the sale of boxes they receive as a donation and pass it on to needy members of the local community. So by donating your boxes you are helping in two ways. You are keeping extra cardboard out of the environment and the landfills, where it will gradually rot while taking up tons of space, and you are also helping needy people within your local community.

When you donate your boxes, call the company first to see how they want you to package them. You may need to make sure all of the boxes are clean, and you may need to break them down. This makes them easier to store for the company that will be reselling them. However, before you start breaking them down, call, because you will be wasting your time if this is not required. Some companies even provide pick-up services for people with a lot of boxes to get rid of.

Offer Them to Someone Else

Do you know someone who is moving too? They might want your boxes, and they might be willing to come and get them from you. If not, put an ad in your paper or in one of the many free online classifieds for your local area letting people know that you have boxes available. If you are donating them to a stranger, make sure you arrange for a safe pick up scenario. You do not necessarily want a stranger to enter your home to pick up boxes, but you could meet in a public location or drag your boxes outside for him to take.

There are many types of bedding common to horse farms across North America. At each barn you will see owners that swear by their bedding type, and assert that it is far better than anything else. But, how can you tell which bedding really is best?

When choosing what to use as bedding, there are several factors to consider. These include the material, its availability, cost, ease of cleaning, disposal and the existing flooring. Because every barn is different, every barn owner makes a different decision when it comes to the best bedding.

Material

The most common types of bedding are shavings and straw. Shavings come in every grade from sawdust to large, thick flakes. While sawdust is more absorbent, it is dusty and not as good for the lungs. Large flake shavings are a lot more expensive, but are a healthier alternative. Straw is the leftover stalks of various grains, usually oats, barley or wheat.. Some straw can be coarse or even prickly, while other types are soft and absorbent. Some horses like to eat straw.

Less common bedding choices include peat moss, processed wood and processed newspaper. All three are more expensive, but have some advantages. Peat moss is very heavy, but is super absorbent and hypoallergenic. Processed wood and newspaper is also very absorbent and hypoallergenic, and also don’t tend to stain the coat. They tend to be very easy to clean, and often are quick to compost.

Cost

Whether we like it or not, cost is always a factor when selecting bedding. It can be hard to justify spending a lot of money just to toss it out the next day. Sawdust is generally the least expensive, usually delivered in bulk. Straw is next on the list, but can be a bit harder to work with. Bagged shavings are fairly expensive, but are a popular choice as they tend to be easy to manage and are nice and fluffy. Peat moss and processed wood or paper are the most expensive, but you also use a lot less of them. Set up costs are high, but long-term they can save money.

Ease of Cleaning

A lot of this is personal preference. There are people who swear by shavings, while others swear by straw. Shavings are generally lighter to handle, and it is easy to remove wet spots and droppings from them. Straw tends to be heavier and can get very soggy. Straw also tends to harbor more odor than shavings. Peat moss is very hard to clean, is heavy, weighing a ton when wet, and tends to pack. Processed wood and paper are very easy to clean, but can be more work to replenish. Often they need to be soaked in water for several hours before spreading, adding to the time required for rebedding stalls.

Disposal

Straw is the easiest bedding to dispose of, especially if you are in an area where you do not have a lot of property. Often mushroom producers will send out a truck to pick up your straw bedding, thus removing it from your farm and taking care of the problem. Straw decomposes well, and can be used or sold as garden manure. Shavings are usually more difficult. Some types of shavings are fairly acidic, and may take a while to decompose. Most mushroom men do not like to use shavings for their produce. Peat moss decomposes quickly, as does processed wood and paper.

Flooring

While the flooring you have may not affect the type of bedding you use, it does affect how much of that bedding you will need. Concrete and asphalt floors are very hard and require deep bedding. Dirt floors are better, and require a bit less bedding, but you still should bed deeply. Rubber mats are a wonderful flooring choice, and greatly reduce the amount of bedding you require. There are even some types of mats that are thick enough to require virtually no bedding at all.

Whatever bedding you choose, it is essential to clean your stalls daily, removing all urine and manure. Keeping your barn clean helps keep your horses healthy, and keeps the odor under control.
